These terms and conditions govern the sales of products on the https://neviabiotech.com/.it/.de/.fr/.es website and regulate its use.
The Seller reserves the right to periodically modify these Terms and Conditions of Sale and the Privacy Policy, for example, due to legislative or regulatory changes or updates to the website's functionality. Such modifications will be communicated to Users via the website with a specific notice for a period of 10 (ten) days from the date of the change. Online sales of products on the website are regulated by the Consumer Code (Legislative Decree No. 206/2005) and the E-Commerce Code (Legislative Decree No. 70/2003). Below are the Terms and Conditions of Sale applicable to any product sold on the website.
ARTICLE 1 – DEFINITIONS
For the purposes of this contract, the following terms shall have the meanings set out below:
- Seller: Nevia Biotech S.R.L., with registered office in Montella (AV) 8348, Italy, at Via Piedipastini 14, email: customer@neviabiotech.com.
- Terms and Conditions or Contract: The set of contractual clauses defining the relationship between the Seller and the Customer.
- Platform or Website: The website https://neviabiotech.com/.it/.de/.fr/.es.
- Users: Any individual accessing and browsing the website.
- Customer: Any individual purchasing products sold through the website.
- Consumer: A natural person acting for purposes unrelated to their trade, business, or profession.
- Products: Over-the-counter medicines, rapid tests, supplements, and similar items sold via e-commerce.
- Purchase Order or Order: The purchase proposal submitted by the User through the website’s procedures, particularly via the Shopping Cart.
- Purchase: The paid acquisition of the aforementioned products from the date of purchase completion.
- Shopping Cart: The stage of the purchase process where the User selects products, payment methods, and delivery options.
- E-Commerce: A specific form of commerce regulated in Italy by the Consumer Code and the E-Commerce Decree, where contracts are concluded remotely without the physical presence of the parties. Delivery is typically handled by third-party operators (couriers/shippers).
ARTICLE 2 – SCOPE
These Terms and Conditions of Sale apply to the products listed in Article 3 and are valid between the Seller and any User purchasing on the website as a Consumer under applicable laws. If any condition is deemed invalid or ineffective, such invalidity shall not extend to the remaining clauses.
ARTICLE 3 – PRODUCT DESCRIPTION
The website sells over-the-counter medicines, rapid tests, supplements, and similar products via e-commerce. All products are described and illustrated in their respective sections. Product images are for illustrative purposes only and may differ slightly from the actual product. Minor discrepancies between images and delivered products are not grounds for dispute unless significant.
Customers may use an online diagnostic tool, which collects personal data (e.g., sex, weight, health-related information) to provide diagnostic or therapeutic suggestions. Data is stored on servers in Switzerland and processed in compliance with GDPR (EU Regulation 679/2016). The tool does not replace medical advice, and users are encouraged to consult a healthcare professional before taking any action.
ARTICLE 4 – PRICES AND ADDITIONAL COSTS
Product prices are displayed on the website. The Shopping Cart will detail:
- Product price;
- Delivery costs (free for orders above thresholds set by the Seller).
Prices may change; the applicable price is the one displayed at the time of purchase. Discounts will reference the product’s price in the last 30 days.
For international deliveries, import taxes/duties may apply and are the Customer’s sole responsibility. Non-EU shipments are subject to variable customs fees, which the Customer must research and pay.
ARTICLE 5 – REGISTRATION
To purchase products, Users must register by providing accurate personal data. By registering, Users confirm they:
- Are legally of age and competent;
- Meet registration requirements;
- Comply with applicable laws and these Terms;
- Own the submitted data.
The Seller may reject registrations for abuse and report violations to authorities. Users must safeguard their account credentials and avoid temporary email addresses. Data is used solely for order fulfillment and, with consent, for promotional communications.
ARTICLE 6 – PURCHASE PROCEDURE AND SALE CONCLUSION
Users may purchase products by:
- Adding items to the Shopping Cart;
- Reviewing prices, payment/delivery options, and Terms;
- Completing payment.
The contract is concluded when the Seller accepts the Order, confirmed via email. The Seller may reject incomplete, incorrect, or unfulfillable Orders (e.g., product unavailability or delivery to remote areas). Refunds will be issued for rejected Orders. The Seller is not liable for damages due to Order rejection.
ARTICLE 7 – PAYMENT METHODS
Available payment options:
- Stripe: Credit/debit cards (Visa/Mastercard).
- PayPal: Secure payments via PayPal account. Refunds are issued to the PayPal account for canceled Orders.
ARTICLE 8 – SHIPPING AND DELIVERY
Products are delivered via couriers (Monday–Friday, excluding holidays):
- Italy: 2–3 working days (7 days for remote areas/islands).
- Tracking numbers are emailed upon shipment.
Customers must inspect deliveries for damage or discrepancies and report issues within 24 hours via email (customer@neviabiotech.com), including 2–3 photos as evidence. Replacement products will be shipped after verification.
ARTICLE 9 – RIGHT OF WITHDRAWAL
Consumers may return products within 14 days of delivery for a full refund by:
- Notifying the Seller via email;
- Returning unused products in original packaging with all documents.
Return shipping costs and risks are the Customer’s responsibility. Refunds exclude return fees. Withdrawal is void for:
- Products received >15 working days prior;
- Used or unsealed items (hygiene/health reasons);
- Perishable/expedited goods.
ARTICLE 10 – LEGAL WARRANTY
Consumers have a 24-month legal warranty under Legislative Decree 206/2005. For defective products, contact the Seller via email with photos and proof of purchase. Minor defects entitle Customers to a price reduction, not contract termination.
ARTICLE 11 – FORCE MAJEURE
The Seller is not liable for delays/cancellations due to force majeure (e.g., natural disasters, IT failures). Orders may be suspended for up to 3 months, after which parties may cancel.
ARTICLE 12 – INTELLECTUAL PROPERTY
The website, its content, trademarks, and domain names are the Seller’s exclusive property. Users may not reproduce, distribute, or use them without written permission.
ARTICLE 13 – LIMITATION OF LIABILITY
The Seller is not liable for website errors, omissions, or inaccuracies, except in cases of wilful misconduct or gross negligence. Customers are entitled to corrections under the Consumer Code.
ARTICLE 14 – NON-WAIVER
The Seller’s failure to enforce a right does not waive future claims for breaches by the Customer or third parties.
ARTICLE 15 – DATA PROTECTION (PRIVACY)
Personal data is processed per GDPR (EU Regulation 679/2016) and stored securely. Data is used for:
- Pre-contractual measures;
- Order fulfillment;
- Promotional communications (with consent).

ARTICLE 16 – GOVERNING LAW AND JURISDICTION
These Terms are governed by Swiss law. Consumer disputes fall under the jurisdiction of the Consumer’s residence.
ARTICLE 17 – DISPUTE RESOLUTION
Consumers may use:
- Alternative Dispute Resolution (ADR);
- The EU’s Online Dispute Resolution (ODR) Platform.

By purchasing, Customers confirm they have read and accepted these Terms, particularly Articles 3, 8, 9, 10, 11, 12, 13, and 16.
